EU court upholds Belgian mobile phone mast tax vs Belgacom, Mobistar
BRUSSELS (AFX) - The EU's highest court has ruled that the Belgian government is entitled to impose a tax on mobile telephone masts, spelling bad news for the country's largest players Belgacom NV and Mobistar SA.
The court said that such taxes are not contrary to EU law, provided that they do not privilege one operator above others who are trying to enter the market and this point is for the Belgian government to decide.
Belgacom and Mobistar appealed against the tax to the European Court of Justice, contesting that EU law does not allow for restrictions on establishment of infrastructure.
